The contract for the transfer of cubature is the contract with which the owner of a fund (transferor) gives the building potential (in whole or in part) to another subject (postponement) who increases the potential of his own land and obtains from the Municipality an increased building permit. Based on the agreement, the transferor renounces on consideration to exploit the cubication that can be made on his own ground so as to allow the transferee to have a greater volume on his fund.
The transferor renounces his building volume, which "takes off" from the source of the transferor and "lands" in the accipient fund of the transferee.
The Postula Institute that the two funds (source and accipient) have:
• the requirement of mutual proximity,
• The same urban destination.
It is a complex act to progressive formation as follows:
• a shop between private individuals,
• An administrative measure that "ratifies" the increase in cubature.
The purpose of the act consists in exercising the ius aedificandi on the transferee.
